We, as tenants, count on a certain amount of discretion from the staff.  We have to come and go through the lobby every day, of necessity coming into contact with a large number of staff members, and, for our own personal reasons most of us do not want our movements to be monitored.  We want to know that if we’re having a bad hair day, the maid or the engineer is not going to call Page 6!  The hotel frequently plays host to high profile media personalities, who have a very understandable expectation of privacy.  These stars will stay elsewhere if they come to feel they can’t trust the staff.

            We here at Legends have the utmost respect for the hotel staff.  It is our belief that  the tenants and staff must stick together in these times of trouble, as both camps are under assault from the minority shareholders, who want to end the old order at all costs. In an ongoing case at the DHCR, many hotel employees were pressured by the minority shareholders to get them to testify against the tenant in the case.  Almost without exception these staff members—union and non-union alike–stood up to the pressure, refusing to inform on a tenant, who, like them, is merely standing up for his or her rights, and for this we applaud their courage and conviction.

However, on Sept. 5, Juan Gaviria, a desk clerk/manager, testified against the tenant in question.  We can’t help but consider this a serious breach of trust.  A reasonable person couldn’t be blamed for concluding that Juan is monitoring his or her business, observing his or her comings and goings, and won’t hesitate to testify against him or her in court.

If  Juan was pressured into testifying, perhaps by the threat of loss of his job, that is truly regrettable.  On the other hand, when asked if he had been coerced, Juan reportedly said no, that he wanted to testify.

            Well, be that as it may, we bear no ill will toward Juan.  But whatever his motives in testifying, residents need to be aware of what he’s doing so that they can take the necessary steps to protect themselves and their privacy. — Ed Hamilton

    Worst of all Juan Gaviria –like Andrew Tilley — fabricated testimony at DHCR, accusing the tenant of things that are contradicted by photographs & videotape…Pretty bonehead move.
    Doesn’t Juan care that if you lie down with dogs you are going to get fleas? He sounds infested.

    must say this quite surprises me. juan has always struck us me as an upright sort. in fact, he stood up for us against bernstein and glennon during a stay last year. glennon was doing a bait and switch on our reservation and juan vouched for us. he’s one of the employees that we miss when we’re far away from the chelsea so it saddens me to think that the pressure may have changed him.

    Juan must vainly believe he’ll be the last employee standing, that his youth and willingness to lie will count in his favor. He cant see how expendable he really is.

    Juan walked into a bad situation when he took that desk job but for certain he’s better off remaining neutral than jeopardizing the respect he has earned from some of us residents. Manipulating the truth to suit David Elder isn’t going to bode well for his future at the Hotel. Elder made his bed when he hired thugs and sent them to intimidate a tenant, now he’s got to deal with any consequences himself

    it sucks that the hotel has to get employees to engage in character assassination. since juan didnt see either assault (this is what led to the dhcr case) then why else bring him to testify? either somebody saw something or they didnt see anything

    Probably nobody really likes having others tell blatant lies about them; that could be one thing that has residents upset, Anonymous. The other is maybe the way new management is trying to evict all long term residents, and have hired security to intimidate and even violently assault tenants who they dislike. You can read up on all this right here on the blog. Its been going on for awhile now.

    um, you don’t see what’s disturbing about employees who are pressured to testify against tenants, and reports of false testimony? The management and staff used to go to great lengths to look after the tenanst and guests and protect them. It was like a family. Now, everyone has to look over their shoulder at all times. It’s a toxic atmosphere. Nice job, Krauss and Elder.
