Well, the worst has finally happened: though it had hung in one form or another for two years, tenant activist Arthur Nash’s BRING BACK THE BARDS banner was removed from the hotel’s façade at approximately 8:45 this morning. Kinda-sorta manager Arnold Tamasar did the honors in person, as a police officer and a security guard stood by.
Obviously, this was not a police matter, but rather a matter for the city agencies and the courts. The cop’s explanation for allowing the sign’s removal was that only the owners of a buiding are allowed to hang signs on the façade of the building. This is open to debate, and in fact it was being discussed with various city agencies. The cop further stated that, since Arthur didn’t have a door to the balcony (like many residents, he climbs through his window), he was not allowed go onto the balcony at all. We believe that the police officer exceeded his authority in aiding the hotel management in their suppression of Nash’s first amendment rights.
The timing of the hotel’s move against Nash, as well as the (former) location of the banner, are significant. On the weekend of June 18, the hotel, in conjunction with No Longer Empty, is planning an art show (featuring mostly outside artists) in the former Capitol Fishing Tackle storefront. Nash’s sign was positioned on the second floor almost directly above the storefront. Obviously it would be a huge embarrassment to the hotel management to have to explain what the sign meant to everyone attending the event.
We believe this to be an illegal infringement on Nash’s first amendment rights. Plain and simple, this is intimidation and harassment meant to stifle all dissenting voices, and as such represents the end of free speech at the Chelsea—if indeed any pretense of it remained after the ouster of the Bards.

But what about the banners people put up on buildings when they stage rent strikes? Those aren’t taken down. And political banners, and American flags? It seems an odd thing for the police to be dealing with.

Ed I hear that any guest or resident seen on their balcony without a door will have the Police called. What a laugh. I’m sure he can pretty much count on the Precinct being called each time an out-of-town tourist is spotted outside their guest room, which can’t be good for repeat business and not so nice for fellow cops who have better things to do, most of the time, than help these lunkheads break the law and trample civil rights.

I wonder what the initial conversations between the hotel and the police were like? Did the hotel management merely call the police and ask their help in removing the banner? or were other forces at work here? I agree with the above comment that it seems like an unusual police activity. I thought police were only involved with criminal activities. This seems more like a security function.

the bards banner may be more fitting for an art show at the chelsea hotel than any number of generics carted in by david elder to fill a retail space that should, by rights, have been rented out long long ago. TO PAYING TENANTS.
the banner says whats really going on here now. the presence of outsiders speaks only to whats already gone down.

Wait isn’t there a hearing scheduled on this? New York City Police have zero right to decide this issue for themselves. A beat cop can’t supercede the City of New York which holds jurisdiction over these matters. If the Cops aren’t holding an order signed by a Judge then the Cops are abusing the color of the uniform and violating this tenant’s rights, plain and simple.

Krauss, Elder and Tamasar — flaming assholes, plain and simple. No respect for the first amendment, no respect for art or artists (their lame PR moves notwithstanding), no respect for the Bards, no respect for the hotel’s history. Do they really think they can erase all the bad will and bad press they’ve built up since they ousted the Bards by removing Mr. Nash’s banner? Too late. It is now etched deeply into history. This just makes them look like bigger idiots. More ego than brains these folks. Can they also get rid of every sign that appears in and around the hotel on the fateful anniversary? I doubt it.

LOL I guess they thought they were real strategists. Arnold Tamasar’s “sentries” hiding under the candy shop awning were being surveilled long before Tamasar came face to face with the tenant. If he felt he had the authority he would have continued taking down the banner but he phoned the Police and wasted some taxpayer dollars. He learned that tactic from his predecessor Andrew “No Willy” Tilley who I remember called the Police on Deb Martin for scribbling “Bring Back the Bards” on a piece of paper. And before him it was nitwit Glennon Travis who invented all kinds of false premises upon which to call the Police. I wonder if they’d call their mommies and daddies if the Police weren’t available to waste their time.

Pathetic, isn’t it, that the only title they could dredge up for this so called “art” show is a response to well-deserved criticism? They call it “Empty No Longer”, yet its a completely empty title. Says nothing.
What it does do is demonstrate from the get-go that its not an art show, after all. Its a mastubatory comment on how long Marlene&David have been able to keep the Bard Family away from home.LikeLike

Good point Sherry in fact it looks like an Internal Affairs probe into this incident is already afoot. The Police broke the law, and blatantly so, and they have David Elder’s inept staff of misfits to thank for any repercussions. IAB investigations go into the Officers long-term disciplinary jacket.

I am so outraged that the new management removed a banner that has been there for almost 2 years that makes people aware of the Bard situation. Explain how they are now are able to forcibly take it down? It has been there despite numerous attempts to remove it and somehow a cop makes a ruling on a Sunday?

Its usually folks who have the most to hide who object to others’ free speech; in my experience, anyway. Kind of an pointless effort tearing a banner down if it leads to a civil rights lawsuit. I think they played right into the tenants’ hands.

i second your outrage easy target but post-bard management’s pattern whether in regard to the banner issue or in the case of the several stop work orders they’ve incurred is to just forge ahead and do whatever they’re doing whether they have legal authorization or not. then they leave the mess for others to clean up when they resign or are fired. its not a very good game plan but its the only one they’ve got
